TITULIA CITY | Admin said today in a statement that President Hock’s nomination was legal. Despite the General Court investigation, Admin says it is legal. Here’s what the Admin said on their blog:
Some citizens recently questioned the legality of the current presidential elections, on the basis that one of the candidates was nominated by a president of a party that is no longer founded.
Contrary to the opinion of these citizens, this election, and all candidates are legal.
Quote from the Constitution:
"Presidents of founded parties may initiate the election of a new president of the republic."
Apparently, the party in question was founded at the time of nomination, otherwise the nomination would not have been possible.
The number of members of any party is continuously changing. It would be neither legally sensible not technically implementable to base any decision on eligibility on some future, therefore unknown information. Once a candidate is legally nominated, he is nominated.
(Real life examples for non-legal minds:
If your national team qualified for the World Cup of 2010 during the qualification rounds in 2008 - 2009, your team will definitely participate the 2010 World Cup, even if the performance of that team changes for the worse between 2009 and 2010.
If voters of a party nominate a US presidential candidate several months before the presidential elections, that person will stand as candidate, even if the voters of that party changed their minds in the meantime. How much support the candidate has at the exact time of the presidential elections is therefore irrelevant.)
